1. Independent seller. AfroScents operates an online marketplace that connects independent sellers and artisans ("Sellers") with buyers worldwide. AfroScents is not the manufacturer, formulator, importer, exporter, distributor, retailer or agent of any product listed by Sellers. All contracts of sale are formed directly between the Seller and the buyer.
2. Seller responsibility. The Seller is solely and exclusively responsible for: the safety, quality, composition, efficacy and accurate description of their products; compliance with all applicable laws and regulations in the country of manufacture, the country of sale and the country of delivery (including but not limited to cosmetic, fragrance, labelling, customs, consumer-protection, advertising, data-protection, tax and intellectual-property laws); obtaining all licences, registrations, notifications and certifications required (including EU CPNP notification, US MoCRA registration, NAFDAC, SABS, SFDA, ISO 22716, IFRA and equivalent regimes); accurate ingredient and allergen disclosure; product liability insurance where required; fulfilment, packaging, shipping, customs clearance, refunds, returns, recalls and after-sales support; and handling buyer complaints, adverse-event reports and regulatory enquiries.
3. No endorsement, no warranty. Verification by AfroScents (including review of this application and any documents or samples submitted) is a basic onboarding check and does not constitute endorsement, certification, regulatory approval, or any warranty — express or implied — as to the safety, quality, legality, efficacy, fitness for purpose, merchantability, authenticity or originality of any product. AfroScents disclaims all such warranties to the fullest extent permitted by law.
4. Limitation of liability. To the maximum extent permitted by applicable law, AfroScents, its affiliates, directors, employees, contractors and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, including (without limitation) personal injury, allergic reaction, illness, death, property damage, loss of profit, loss of revenue, loss of data, loss of goodwill, business interruption, regulatory fines, customs seizure, or any claim arising out of or in connection with any product purchased through the marketplace, any Seller act or omission, any user-generated content, or any reliance placed on information provided by a Seller.
5. Indemnity. The Seller agrees to defend, indemnify and hold harmless AfroScents and its affiliates from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) any product supplied by the Seller; (b) any breach by the Seller of these terms, applicable law or third-party rights; (c) any misrepresentation in this application; (d) any injury, illness, reaction or damage suffered by any buyer or third party in connection with the Seller's products.
6. Removal & suspension. AfroScents may, at its sole discretion and without liability, refuse, suspend, delist or remove any product, listing or Seller account at any time — including on receipt of complaints, safety concerns, regulatory notices, or suspected breach of these terms or applicable law.
7. Counterfeits & prohibited items. The Seller warrants that products are authentic, lawfully sourced and do not infringe any third-party intellectual-property rights, and that no prohibited, restricted, adulterated, mislabelled or counterfeit goods will be listed.
8. Data accuracy. The Seller confirms that all information, documents and samples submitted in this application are true, complete and accurate, and undertakes to notify AfroScents promptly of any material change.
9. Governing law. The relationship between the Seller and AfroScents is governed by the AfroScents Seller Terms (provided on acceptance). Nothing in this disclaimer excludes or limits liability that cannot lawfully be excluded.
